Short answer: yes today, no as of November 12, 2026 — 63 days from now. THCA flower is currently sold as hemp because the 2018 Farm Bill measured only delta-9 THC, and raw THCA is not delta-9 until it is heated. Section 781 of the 2026 appropriations act deletes that distinction: the federal test becomes total THC, expressly including THCA, capped at 0.3% by dry weight. Essentially all THCA flower on the market is well above that line once THCA counts.

That single change is why this category is affected more completely than any other. Of the 759 THCA listings we track across 32 vendors, effectively none would pass a total-THC test. The law was signed 2025-11-12 and takes effect exactly one year later. It is not retroactive, so purchases made before that date were lawful when made — but no sell-through period was written into the statute for sellers.

Two caveats worth more than any headline. First, state law is separate and often stricter — Texas moved against smokable hemp in March 2026 and the rule has been tied up in court since; several states banned these products years ago. Second, delay bills exist but none has passed: H.R. 7024 / S. 3686 would push enforcement to 2028 and remained in committee as of 2026-07-23. Check your own state's current law before ordering anything, and treat the date as firm until Congress actually moves it.

While it is still sold, the honest way to compare it is ¢ per mg of THCA — price ÷ (weight × tested potency) — because a cheap low-potency pound routinely costs more per milligram than a pricier strong one. What exactly changes on November 12, 2026?
The federal definition of hemp changes from a delta-9-only test to a total-THC test that expressly includes THCA, capped at 0.3% by dry weight. Finished products also face a separate cap of 0.4mg total THC per retail container. Products falling outside the new definition are no longer hemp and fall under the Controlled Substances Act.

Does the ban apply to flower I already bought?
The change is not retroactive — it applies going forward from November 12, 2026. It does not, however, include a written sell-through period for retailers, which is why supply is expected to tighten well before the date.

Could the date still move?
Yes. H.R. 7024 and S. 3686 would delay enforcement to November 2028, H.R. 6209 would repeal Section 781 outright, and the White House asked Congress in June 2026 to revise it. As of 2026-07-23 all remained in committee and the 2026 Farm Bill passed the House with the ban untouched. Nothing has changed the date yet.

Why is THCA affected more than CBD?
Because the new test counts THCA toward total THC. CBD, CBG, CBC and CBN are not THC-class cannabinoids, so products built on them can still qualify as hemp provided the finished container holds no more than 0.4mg of total THC. Full-spectrum CBD carrying trace THC is the genuinely uncertain case.
