The 2026 Hemp Ban: What's Banned, What Isn't

On November 12, 2026 — 63 days from now, Section 781 of the Agriculture / FDA appropriations act rewrites the federal definition of hemp. It was signed 2025-11-12 with a 365-day delay. Most coverage describes it as one rule. It is actually three separate tests, and a product only has to fail one.

Test 1 — plant material. Total THC of no more than 0.3% by dry weight, now expressly including THCA. The 2018 Farm Bill counted only delta-9, which is the entire basis on which THCA flower is sold today. Test 2 — finished products. No more than 0.4mg of total THC per retail container, meaning the innermost package the product is sold in. That threshold is below almost every gummy, cartridge, tincture and beverage on the market. Test 3 — origin. Cannabinoids that are not naturally produced by the plant — the synthesized or converted ones — are excluded entirely, regardless of dose. That is the test that removes Delta-8, Delta-10, HHC and THCP, and it is the one almost nobody explains.

Applied to our own index, the arithmetic is stark: of 1,515 live listings from 35 vendors, 88.2% fail at least one test — 1,336 products — and 18 of those vendors lose their entire catalogue. That is independently computed from the prices on this page and lands close to the US Hemp Roundtable's own ~95% estimate.

What survives: industrial hemp for fiber and grain, and CBD, CBG, CBC and CBN products whose finished container stays under the 0.4mg total-THC cap. CBD isolate is the cleanest survivor. Full-spectrum CBD is the real open question — trace THC can breach the per-container cap, which is precisely why the White House asked Congress in June 2026 to amend the provision to protect it.

One more thing worth knowing, because it is being widely reported as settled and is not: the FDA was required to publish three lists defining which cannabinoids count as THC-class or "similar effect", and it missed the 90-day deadline. As of 2026-07-23 those lists were still unpublished. Any page telling you CBN or CBG is definitively safe is guessing ahead of the agency.

Who enforces it, and how hard?
Products outside the hemp definition fall under the Controlled Substances Act, enforced by DEA, with FDA acting on labelling and adulteration. The Congressional Research Service has said it is unclear if and how the agencies will enforce, and that FDA and DEA may lack the resources to police the market broadly. Practitioners expect selective, risk-based enforcement.

Can Congress still stop it?
It could. H.R. 7024 / S. 3686 would delay to November 2028, H.R. 6209 would repeal Section 781, and H.R. 9830 would replace it with a regulatory framework. As of 2026-07-23 all were in committee with no scheduled vote, and both the House-passed 2026 Farm Bill and the Senate Agriculture draft left the ban untouched.

Is my state's law different?
Very likely. Federal law sets a floor, not a ceiling, and states regulate independently — some banned these products years ago, Tennessee licenses them under a stricter regime, and Texas rules have been in litigation through 2026.
