The 2026 hemp ban is not a ban on hemp. It removes intoxicating cannabinoids from the federal definition and leaves the rest in place. Of the 1,515 products we track, 179 sit on the surviving side of the line — and this page is the live ranking of them, by ¢ per mg, from 14 vendors.

What clearly stays: industrial hemp for fiber, grain and seed, and non-intoxicating cannabinoid products — CBD, CBG, CBC and CBN — provided the finished retail container holds no more than 0.4mg of total THC. CBD isolate is the cleanest survivor of all, because isolate contains no THC to count in the first place.

What is genuinely uncertain, and where you should distrust any page that sounds confident: full-spectrum CBD. Full-spectrum products retain trace THC by design, and whether a given one clears 0.4mg per container depends entirely on its formulation and container size. This is not a hypothetical edge case — it is the specific thing the White House asked Congress in June 2026 to fix, requesting the definition be revised so Americans keep access to "appropriate full-spectrum CBD products".

Also unsettled: CBN, CBG and CBC boundaries. The statute requires the FDA to publish lists of naturally producible cannabinoids, THC-class cannabinoids and others with similar effects, with the HHS Secretary defining that last group. The FDA missed its 90-day deadline and the lists were still unpublished as of 2026-07-23. Until they appear, treat confident claims about minor cannabinoids as guesses.

One older rule that is not part of this ban but still applies: the FDA's long-standing position that CBD may not be added to food or marketed as a dietary supplement, and that no product may carry unapproved health claims. That predates Section 781 and is unchanged by it.

Anyone stating this as settled is ahead of the agency.

Does industrial hemp survive?
Yes. Hemp grown for fiber, grain, seed and other non-cannabinoid uses is unaffected. The provision targets consumable intoxicating cannabinoid products.
