Most explanations of the 2026 hemp ban talk about milligram limits, which leads people to a reasonable but wrong conclusion: that a low-dose Delta-8 product might squeak under the cap. It cannot. Delta-8 is not removed by a dose threshold. It is removed by a separate test that asks where the cannabinoid came from.

Section 781 excludes cannabinoids that are not naturally produced by the cannabis plant. Delta-8 exists in raw hemp only in trace amounts far too small to extract commercially, so essentially all Delta-8 on the market is converted — manufactured from CBD in a lab. The same is true of Delta-10, HHC, THCO and, in practice, THCP. Under the new definition that manufacturing route puts them outside "hemp" regardless of how much ends up in the bottle. A 2mg Delta-8 gummy and a 100mg one fail identically.

This is why the three tests matter more than the headline number. Test 1 (0.3% total THC including THCA) is what removes THCA flower. Test 2 (0.4mg total THC per container) is what removes conventional edibles and cartridges. Test 3, the origin test, is what removes this entire category — and it is the one that cannot be formulated around. There is no compliant version of a converted cannabinoid.

Is low-dose Delta-8 still legal after the ban?
No. Delta-8 is excluded by origin, not by dose. Section 781 excludes cannabinoids not naturally produced by the plant, and commercial Delta-8 is converted from CBD in a lab, so the milligram limits never come into play. A low-dose product fails the same test as a high-dose one.

Which cannabinoids does the origin test remove?
The converted and synthesized ones — Delta-8, Delta-10, HHC, THCO and, as sold commercially, THCP. Cannabinoids the plant produces naturally, such as CBD, CBG and CBC, are not caught by this test.

Does that mean naturally occurring delta-9 is fine?
Not automatically. Naturally occurring cannabinoids still have to clear the other two tests: 0.3% total THC by dry weight for plant material, and 0.4mg total THC per retail container for finished products. Passing the origin test only means a product is not disqualified on that ground alone.

Why did Congress write it that way?
The stated aim was closing what lawmakers called the hemp loophole — the gap between the 2018 Farm Bill's delta-9-only measurement and the intoxicating products that measurement permitted. Targeting manufacturing origin closes the route of converting legal CBD into an intoxicating cannabinoid.

Could the FDA lists change which cannabinoids are covered?
They could sharpen the edges. The statute directs the FDA to publish lists of naturally producible cannabinoids, THC-class cannabinoids, and others with similar effects, and gives the HHS Secretary authority over that last category. The FDA missed its 90-day deadline and as of 2026-07-23 had published none of them, so the boundaries around less common cannabinoids remain genuinely unsettled.
